EUROPEAN UNION (EU) AND UNITED KINGDOM (UK) ADDENDUM
In addition to the terms of our policy above, the terms contained in this addendum apply to those persons who are residents of and/or access our Website or Services within the EU and UK.
FURTHER INFORMATION FOR RESIDENTS OF THE EU AND UK
Personal Information may be transferred to our Website servers and/or third-party processors or subcontractors that are located outside of Canada and into the United States of America. Where possible, we strive to use website hosting service providers who actively participate(s) in the EU-U.S. and Swiss-U.S. Privacy Shield framework.
Legal Basis for Processing. As described above, our processing (i.e., collection and use) of your personal information is based on one of a number of legal conditions. Generally, these include: (i) your consent; (ii) the performance of a contract with you; (iii) compliance with a legal obligation (for example, where we are required to disclose personal information to a court or a tax authority); and (iv) our legitimate interests, provided these do not override your fundamental rights and freedoms (for example, where we carry out research and analysis to improve our Website and Services).
Rights of UK and EU Residents. Subject to applicable law, as a resident of the UK or the EU, you may have certain rights with respect to your personal information. These rights may include some of the following:
to obtain a copy of your personal information together with information about how and on what basis that personal information is processed;
to rectify inaccurate personal information;
to erase your personal information (in limited circumstances, such as where it is no longer necessary in relation to the purposes for which it was collected or processed);
to restrict processing of your personal information where: (i) the accuracy of the personal information is contested; (ii) the processing is unlawful but you object to the erasure of the personal information; or (iii) we no longer require the personal information, but it is still required for the establishment, exercise or defense of a legal claim;
to challenge processing which we have justified based on a legitimate interest;
to prevent us from sending you direct marketing;
to withdraw your consent to our processing of your personal information (where that processing is based on your consent); and
to obtain, or see a copy of, the appropriate safeguards under which your personal information is transferred to a third country or international organization.
In addition to the above, you have the right to lodge a complaint with your local supervisory authority, depending on where you have your habitual residence or place of work, or where an alleged infringement of applicable data protection law occurs (for example, the Information Commissioner’s Office in the United Kingdom, contactable at www.ico.org.uk). For the European Economic Area (“EEA”), a list of data protection authorities is available at https://edpb.europa.eu/about-edpb/about-edpb/members_en.
Exercising Your Rights. If you would like to exercise any of the rights described above, please submit a request using the contact details listed below. Please note we will request proof of your identity, and verify such identity, in order to protect your personal information and ensure compliance with all applicable regulations and policies. In some cases, we may limit or deny requests where permitted or required by law. For example, except where disclosure is required by law, we may decide not to grant access or make revisions where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in any given case, or when the rights of others would be violated by granting the access. Additionally, we may deny a request if we are unable to adequately verify your identity. We reserve the right to charge a fee where permitted by law, including for example, if your request is manifestly excessive or unfounded. We will respond to your requests within the applicable timeframes and consistent with applicable regulations.
International Transfers for UK and EU Residents. Our company is based in Ontario, Canada. As part of the operation of our Website and provision of Services, your personal information may be transferred to and stored in the United States for processing. Additionally, any personal information that you provide to or that is collected by or on behalf of us may be transferred or accessed by entities around the world consistent with the practices described within this privacy policy. The privacy laws in these countries may be less stringent than the laws in your country of residence. In relation to service providers or suppliers, for personal information that is transferred outside of the UK and the EEA, we rely on adequate measures (such as the EU Commission-approved Standard Contractual Clauses), which give personal data the same protection it has in the UK and the EEA. If we send your personal information to Canada it is protected under Canadian law, which the European Commission has found will adequately protect your information. You may have a right to request additional details about the mechanisms under which your data is transferred outside of the UK and the EEA. If you would like more information concerning our attempts to apply the privacy principles applicable in one jurisdiction to data when it goes to another jurisdiction you can contact us using the contact information below.
Complaints. If you are an EU resident, you have the right to complain to a supervising authority if you believe we are misusing your personal information or have violated any of your rights under this privacy policy or applicable law. You may do so in the EU member state in which you reside or have your place of business or in which the alleged infringement took place. If you are located outside the EU, you may have rights under privacy laws in the jurisdiction where you reside.
